GroupFlow is a Service of Moxley Data Inc. This Privacy Policy describes how we, Moxley Data Inc, obtain and use information about you and your visits to our website at https://www.groupflow.app, the Group websites hosted by GroupFow, and the GroupFlow mobile application. To offer the personalized experience of a GroupFlow Group and quality Service, we collect personal information about you (“Personal Data”). This policy describes how we collect, use, and share your Personal Data.

All visitors to our Service (“Visitors”) who join a GroupFlow Group are Members of the Group. Customers of the GroupFlow Service are either Groups or Group Leaders, depending on the context. Group Leaders are Group Members who have the authority to act on behalf of their Group to do business with GroupFlow.

Information we collect and how we use it

Voluntary Information

When you use GroupFlow, you give us certain information voluntarily. This includes your name, email address, phone number, Group Member profile information, messages, and any other information you give us or to your Group through our Service. When you interact with a Group through our Service, we collect and process this information solely on behalf of the Group.

Groups are responsible for Visitors' information, including for its legality, security and integrity. Please contact your Groups for information on how they use your personal information.

Technical Information

GroupFlow collects technical information from you, including IP address, device make and model, operating system, web browser, and web browser cookies that are automatically sent by your device or web browser.

We also may collect information about how you use the app or your Groups' GroupFlow-hosted websites, including which pages were visited, which screens were shown, which buttons and actions were taken, and the date and time of these events. This kind of information is known as Click-Flow Data. GroupFlow uses Click-Flow data to improve the Service, and personalize your experience with the Service.

GroupFlow also shares aggregated and anonymized version of Click-Flow Data to your Groups to provide them with information to help them provide a better experience for their Members.

We use cookies to track you between different web pages on a Group's website. Cookies are text files placed on your computer by websites. One of our cookies, a “Login Cookie”, enables us to identify you as a logged-in member of your Group. Without a Login Cookie, we cannot log you in. We also use cookies for our legitimate interests to track usage of our Service, to measure the number of unique visitors of our Service, and to help us make our Service more valuable to Groups and Members. The use of this tracking information is called “analytics.” Often information used for analytics is aggregated.

Our mobile application on iOS (Apple) and Android (Google) has to interact with our computer servers. As with the Login Cookie on a website, we assign your device a token so that you do not have to log in every time you use the Service via our mobile apps.

You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some of our Service features may not work properly without cookies, and you will not be able to log in. Most browsers accept cookies automatically but allow you to disable them. What we do with the information we collect

We use your Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To further develop, customize, expand, and improve our Services, based on Groups' and Members’ common or personal preferences, experiences and difficulties;

  3. To provide our Groups with ongoing customer assistance and technical support;

  4. To be able to contact our Groups with general or personalized service-related notices and promotional messages;

  5. In the case of our website, groupflow.app, help us to update, expand and analyze our records to identify new customers;

  6. To facilitate, sponsor, and offer certain events and promotions, and monitor performance;

  7. To analyze our performance and marketing activities;

  8. To create aggregated statistical data and other aggregated and/or inferred information, which we or our business partners may use to provide and improve our respective services;

  9. To provide you with professional assistance, only upon your request;

  10. To enhance our data security and fraud prevention capabilities; and

  11. To comply with any applicable laws and regulations.

We use your Personal Information for the following purposes:

  1. Our use of your Personal Information as a Group Leader is necessary to perform a contract or to take steps to enter into a contract with you (e.g. to provide you with a website builder, to provide you with our customer assistance and technical support); Our use of your Personal Information as a Group Member is necessary to provide our Service to you and your Groups.

  2. Our use of your Personal Information is necessary to comply with a relevant legal or regulatory obligation that we have; or

  3. Our use of your Personal Information as a Group Leader is necessary to support legitimate interests and business purposes (for example, to maintain and improve our Services and the effectiveness of GroupFlow by identifying technical issues), provided it is conducted in a way that is proportionate and that respects your privacy rights.

How and when we share information

We consider personalizing your GroupFlow experience an important part of our Service. We want you to understand what Personal Data gets shared with your Groups, other Members of your Group, other Groups or Members of our Service, and other third parties as part of the Service.

‘Third Party’ means a person or company besides GroupFlow, who is not a Group or Group Member. This does not include government bodies, public agencies, or authorities. Third Parties include our service providers whom we authorize, through a data processing agreement, to process your personal data or information to help us with: development, maintenance, and support of our website and mobile application, marketing and advertising, marketing research and analysis, communications, and customer service. We do not permit our Third Party service providers to use your personal data for any other purpose. We do not share Personal Data with any person or company unless we have an agreement with them that controls their use of the data.

‘Processing’ or ‘Process’ means any operation or set of operations performed on personal data or on sets of personal data, including by automatic methods, such as collecting, recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing, transmitting, sharing or otherwise making available, aligning or combining, restricting, erasing or destroying.

‘Consent’ or ‘Agree’ means your freely given, specific, informed and unambiguous expression of your wishes through a statement or other clear affirmative action such as checking a box which indicates your agreement to our processing of personal data relating to you.

If you are not comfortable with this type of sharing, don’t use our Service.

A. Personal Data shared within the Service

Your Group. Your Group, or Groups if are there more than one, will have access to your name, email address, and all personal or contact information that you provide when you register for that Group. In order to facilitate Member engagement, your Group will also have access to Data regarding your usage activity, in both aggregated and personally identifiable forms. For example, Groups will be able to see aggregated Member activity, as well as specific information like how many people liked a comment you made. Your Group also will be able to associate Your Content, and any Personal Information it contains, with your contact information. Your Groups may communicate with you outside of the Service about the Group or relevant topics of interest to you, and may retain your personal information after you leave the Group, unless you request otherwise. Groups have committed in the GroupFlow Terms of Use to comply with applicable laws and regulations about their handling of Data and not to sell your information to third-parties. You should only join a Group if you are comfortable sharing your personal information with the Group. If your Group has an additional privacy policy covering the Group’s use of Personal Data, you should review it carefully to understand how your Group may use Personal Data.

Searching and Messaging by Others. Members of your Group can search for you by your public profile, or other personal information so that they may message you within the Group.

Any Visitor can find your Group, but cannot enter without a membership request approval. Only Members of the Group can see Profiles, Your Content, and activity.

Personal Information Included in Your Content. If you include personal information in Your Content, it will be displayed to other Members.

B. Personal Data and Information shared with Third Parties

Integrated Services. If you have used the option to use an integration with a third party (Integrated Service), such as Discord, we share your information with the operators of the Integrated Service. More information is in the sections below entitled “Integrated Services.”

Business Transfers. As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, or similar event, Personal Data may be part of the transferred assets.

Agents, Consultants and Third Parties Whom We Have Contracts With. Moxley Data Inc., like many businesses, sometimes hires other companies to perform certain business-related functions. Examples include emailing information to you, maintaining our website, databases and mobile applications, processing payments, marketing and advertising, marketing research and analysis, and customer service. When we employ another company to perform a function of this type, we only provide them with the Personal Data and Information they need to perform their specific function and we do not authorize these service providers to use or disclose your personal information except as necessary to perform the tasks we have asked them to do for us or to comply with legal requirements.

Legal Requirements. We may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) cooperate with a legal investigation or a request from a government authority, (iii) protect and defend the rights or property of Moxley Data Inc., (iv) protect the legal rights, safety, and security of users of our website and the Service, (v) protect our legal rights and legitimate interests, and those of our business partners, service providers, and customers; (vi) prevent fraud; (vii) act in urgent circumstances to protect the personal safety of users of the Service or the public, or (v) protect against legal liability.

C. Aggregated data shared

We disclose aggregated statistics, such as number of Groups and Members, in order to describe our Service to current and prospective business partners, and to our Third Party service providers for our legitimate interests and other lawful purposes.

Data Rights

You have rights regarding the Personal Data and Information we have about you.

You may object to, or restrict, our collection, use, sharing, transfer and/or storage of your personal information. You may also request a copy of the information that we have about you. You may also ask us to correct or remove personal information you think is incorrect.

If a Group (the data controller) is using the Service to process your personal information, you may contact the Group to object, restrict, access, correct or delete your personal information. If you need help finding contact information for your Group’s privacy officer, please contact us using the contact information described near the end of this document.

If you have a Member account with a Group in the Service, you may object, restrict, access, correct, or request deletion or a copy of some or all of your Personal Data or Information by contacting the Group.

If you do not have a Member account with the Group in question, and you would like to object, restrict, access, correct, delete, or request a copy of some or all of your personal information, please email, write, or call us at the contact information described near the end of this document.

We will respond to your request within a reasonable period of time.

Please note, we will keep your personal information for as long as necessary for us to provide the Service to you. We will also keep and use your personal data or information to comply with laws including tax laws and other applicable laws. We will also keep your Personal Data and Information as necessary for backup, archiving, audit, preventing fraud, resolving disputes, and troubleshooting problems.

Choices you have about your information

Our goal is to give you simple and meaningful choices regarding your information. If you are a Member of a Group, many of these controls are built directly into GroupFlow or your settings within the Group's website. For example, you can:

  • Edit information in your Member profile within your Group at any time. Your name, profile photo, pronouns, date you joined your Group, and city of residence are always available to other Members to see. For all other parts of your Member profile, you may decide what parts of your profile are available to other members in your group.

  • Link or unlink your GroupFlow account from other services (like Discord).

A. Join Groups you trust

You get to decide the Groups you want to join. You also get to decide whether you trust your Group with the information sharing described in this policy.

B. Adjust your notification settings

In your account settings within your Group, you can control the type and mode of notifications you receive through the Service. You can choose to be notified by email or mobile alerts, both, or neither. You can choose to turn on or off your notifications by type, such as group announcements, event announcements, and direct chat messages.

Some types of notifications cannot be opted out of, as these types are required to maintain your membership with your Group. Examples include password change email and email confirmation email.

C. Opt out of email from GroupFlow

We would like to send you, as a Group Leader, information about our services that you may be interested in. If you have agreed to receive marketing messages from us, you may opt-out at any time. We provide an opt-out link at the bottom of each email message.

Because we plan our communications in advance, it may take several weeks for your opt-out request to take effect. If you continue to receive marketing messages from us after you opt-out, please let us know so that we can investigate the situation.

D. Deleting cookies

To manage or delete browser cookies, please see your browser’s privacy settings.

Account termination

You can leave one or more of your Groups, or delete your Group account (on a Group by Group basis). As soon as you leave, we stop collecting your Personal Data for that Group. To delete your Group account, contact the Group directly.

Exclusions

This Privacy Policy does not apply to any Personal Data collected by Moxley Data Inc. outside the Service, such as a telephone call. This Privacy Policy does not apply to any unsolicited information you provide to Moxley Data, Inc. through the Service or through any other means, such as information posted to any public areas of the Service, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Moxley Data, Inc. shall be free to reproduce and use such Unsolicited Information without limitation or attribution. We respect your copyrights in Your Content, as outlined in our Terms of Use.

Disputes with Groups or Members

GroupFlow cannot control the actions of Groups or other Members; if you have a privacy-related dispute with a Group or another Member, you should contact that person directly. You should alert us help@groupflow.app if you believe that a Group or another Member has violated this Privacy Policy or our Acceptable Use Policy.

Children

GroupFlow does not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, please do not use the Service or submit any Personal Data through the Service. If you have reason to believe that a child under the age of 13 has provided Personal Data to GroupFlow through the Service, please contact us at help@groupflow.app and we will look to delete that information from our databases.

Links to other websites

This Privacy Policy applies only to the Service. The Service may contain links to other websites not operated or controlled by Moxley Data Inc. (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Service do not imply that Moxley Data Inc. endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information about their privacy policies and practices.

Integrated Services

One of the special features of the Service is that it allows you to enable various online Third Party services, such as social media and social networking services like Discord and Meetup (each, an “Integrated Service”), to integrate directly into your Group. By directly integrating these services, we make your use of GroupFlow richer and more personalized. To enable Integrated Services, we will ask you to authorize GroupFlow to access the Integrated Services (or vice versa). When you add an Integrated Service account to a Group (or vice versa), your Personal Data, non-personal data, location information, your content, your Group name, your Group location, your GroupFlow affiliation, profile photo, Facebook Connect ID, Profile, and other relevant personal information may be passed through to, or received from, the Integrated Service in connection with your use of the Service. We may import, use, disclose, and retain such data and information to, among other things, customize and improve the Service for you and others. Note that Integrated Services may also import, use, and retain this information. You may be able to control how certain information is shared with us in your privacy settings within the Integrated Services. However, please remember that the manner in which Integrated Services collect, use, store, and disclose your information is governed solely by the policies of the companies operating those Integrated Services, and we shall have no liability or responsibility for the privacy practices or other actions of any Integrated Service that may be enabled within the Service.

If, and only if, you have elected to integrate your Group Member account with an Integrated Service, we may share your information with Integrated Services. This may happen when you first register with the Group, or when you log into the Group's GroupFlow website from time to time. We may from time to time share your Personal Data and anonymous data, your location information, your Group Membership, your Group URL, your location, and your use of certain features on GroupFlow with Integrated Services to facilitate and enhance your use of the Integrated Services. Please keep in mind that services provided by Integrated Services are not provided by us and therefore your use of the Integrated Services will be governed by the Integrated Services’ Terms of Use and other policies, and that the collection, use, and disclosure of information provided by you or us to Integrated Services is not governed by this Privacy Policy.

Security

We use appropriate technical and organizational measures including encryption, aggregation, and pseudonymization to protect your Personal Data provided via the Service from loss, misuse, and unauthorized access or use, disclosure, alteration, or destruction. However, no Internet, email, or other electronic transmission is ever 100% secure or error free, so we cannot guarantee that your Personal Data will never be accessed, used, or disclosed, so you should take special care in deciding what information you share on the Service.

“Phishing” is a scam designed to steal your Personal Data or Information. If you receive an email that looks like it is from us asking you for information about you, please contact us at help@groupFlow.app.

California residents

If you are a California resident using the Services, the California Consumer Privacy Act ("CCPA") grants you the right to request access to and deletion of the Personal Information GroupFlow collects about you, as well as to request that we disclose how we collect, use, and share your Personal Information.

California residents also have a right to opt-out of the sale of their Personal Information by a business and a right not to be discriminated against for exercising any of their rights under the CCPA.

No sale of Personal Information. GroupFlow does NOT sell (as such term is defined in the CCPA) your Personal Information to third parties, and GroupFlow has not sold Personal Information in the past.

No Discrimination. GroupFlow does not discriminate against any User for exercising their rights under the CCPA.

California consumers can exercise their CCPA rights directly or through an authorized agent by contacting us at help@groupflow.app. Please note: in order to protect your accounts and Personal Information and safeguard your privacy rights, we will verify your deletion and access requests, and to that extent, we may ask you for additional information or documentation (depending on the case), such as account related information, and, in some cases, billing information used to purchase paid Services, and a copy of documents that can assist with verifying your identity.

Such identification documentation (if requested) will be used only for verification purposes and we will delete it after your request is processed.

The following instructions apply to Personal Information we may collect from California residents on or through our Services.

Right to Know: If you want to exercise your right to know or receive a copy or access the Personal Information that you have stored with us, please contact us at help@groupflow.app.

Right to Deletion: If you want to exercise your right to request deletion of any of your Personal Information that you have stored with us, please contact us at help@groupflow.app.

Once we receive and verify your consumer request, we will delete your personal information from our records unless an exception applies. We will make reasonable efforts to honor your request promptly and consistent with requirements under applicable law.

Please note that permanently deleting your GroupFlow account erases all of your Personal Information from GroupFlow's databases. After completing this process, you can no longer use any of your GroupFlow Services using your account, and all its data will be removed permanently, and GroupFlow will not be able to restore your account or retrieve your data in the future. Additionally, if you contact our support channels in the future, the system will not recognize your account, and support agents will not be able to locate the deleted account.

If you cannot access your GroupFlow account or if you wish to exercise your CCPA rights through an authorized agent operating on your behalf, you, or your authorized agent (as applicable) may send a request to help@groupflow.app. To process your request, in order to protect your account and Personal Information, we may ask you or your authorized agent for the verifying information detailed above, which may vary according to the circumstances of your request. Authorized agents will also need to provide GroupFlow with a copy of your signed authorization designating them as their agent.

EU/EEA/UK

Our Service is provided from within the United States and subject to state and federal laws of the United States. If you are located outside the United States, your Personal Data is being transferred to, stored, used, and shared in the United States.

If you are a resident of the EU/EEA or UK, please note that this Service does not have a privacy policy that specifically addresses EU/EEA or UK concerns.

Changes to privacy policy

We keep this Privacy Policy under regular review, and we will notify you when we make changes in the future. Please review this policy periodically, and especially before you provide any Personal Data to us. We will also place any updates on our website. This privacy policy was last updated on the date indicated at the top of this document.

We have no liability or responsibility for the privacy policies or practices of our Hosts or other actions of any Integrated Service that may be enabled within the Service.
